AI and LAW:Navigating the Future of Justice:
As you know AI has been stealing many jobs and also helping people in daily lives however AI is not limited to this, AI is becoming more human than the human so just like human commits crime, there are more chances of AI to commit crime and not just AI, human with criminal mindset will help the AI to commits crime however technology brings not just bad but good. We can solve crime with the help of AI so, for everything- to commit a crime by AI and to solve a crime by AI we need laws and this is where laws prevail in everything so we will discuss everything and let us first know what is AI.
What is AI:
The word AI stands for Artificial intelligence. It’s a technology that is designed to work, feel, think and move like a human or you can say that humans are trying to make humans. AI refers to simulation of human intelligence in machines that are programmed to think, reason, and learn like humans rather than being programmed for specific tasks. It has wide range of technology such as machine learning, natural language processing, computer vision and so many other technologies.
What is Law:
Law is a constitution that regulates, governs and maintains order in society. Law helps to maintain a peaceful society by providing justice to the victims and punishing the culprit. Its not limited to anything, law is like human beings developing day by day just like our technology. There are many laws related to cyber crime such as information technology act 200, IT (Certifying Authorities), rules 2000, IT(Security Procedure) rules 2004 and there are more laws. So, law is in every field however there is no current law dealing with AI.
Applications of AI in Law
AI is changing the old legal traditional domain and revolutionising the practice of law:
Legal Research and Analysis:
AI is helping in legal research making it easier to research and saving more time. AI-powered tools like ROSS Intelligence and Case text streamline legal research by analyzing case laws and statutes, significantly reducing time and effort.
Contract Review and Management:
Drafting a contract can be stressful and there may be some errors while drafting however AI can help to draft a contract with no human error. Tools like LawGeex help automate contract review, ensuring accuracy and compliance while minimizing human errors.
Predictive Analytics:
Lawyers need to research based on the data available to predict the outcomes of any case and this made the job stressful, consuming caffeine everyday and night, researching, collecting data and so on however AI made the job easy. AI predicts case outcomes based on historical data, aiding lawyers in decision-making and litigation strategies.
Virtual Legal Assistants:
Getting legal assistants on minor issues was not easy in traditional time, hiring a lawyer, spending money. People used to avoid legal assistants on minor issues however AI made legal assistants more easy and flexible. This made justice achievable on each and everything.Chatbots like DoNotPay assist individuals with minor legal queries and even draft letters, making legal aid more accessible.
Challenges Posed by AI in the Legal System:
AI poses many challenges in the legal system even after having so much potential.
There are chances of bias discrimination, lack of accountability, breach of data privacy, lack of regulation and stealing jobs.
Bias and Discrimination:
Not just humans are bais, AI is bais too. AI can be biassed and discriminatory on the bases of the data collected by AI and that particular data led to the biases because all those data were either written by humans or made by humans and as we know, we humans are discriminatory towards each other. AI systems often inherent biases from their training data, leading to unfair outcomes in sensitive areas such as criminal sentencing or hiring practices.
Accountability and Liability:
We know that AI is error free but nothing is perfect in this world. AI is still developing and collecting the data made by or written by humans and humans make errors so thus AI will. But the main question is if AI makes an error then who is accountable? a software developer? A company?
When AI makes decisions, determining accountability becomes complex. For instance, who is liable for errors—a software developer, a company, or the user?
This led to the lack of accountability and lack of liability.
Data Privacy and Security:
Since AI is collecting the date to be more perfect this raised a concern of breach of privacy.
AI is collecting all types of data making humans fear their privacy and security and this may lead to cyber crime such as cyber bullying and fraud.
Job Displacement:
Job displacement by AI is the most fear among the youth because AI has already displaced many jobs that led to the unemployment among youths. This is alarming because soon AI will rule the world and humans will be slaves if this continues. We are not making humans like, we are making our own enemy that will destroy our world. Those sci fi movies were not fictions, they were real and AI will do the same just like those sci fi movies.
Legal Frameworks Governing AI
Global legal system beginning to address the challenges posed by AI and starting to make laws of AI to regulate and to govern AI.
European Union:
The European Union made a law to regulate AI which is known as The EU’s Artificial Intelligence Act. This aims to establish a regulatory framework to ensure AI is used responsibly.
United States:
There are some States like California that have introduced AI-specific laws, focusing on transparency and accountability.
India:
There is no such law related to AI in India.
